AKSEN Journal of Contemporary Islamic Law (AJCIL)

1. License

All articles published in AJCIL are licensed under the Creative Commons Attribution-ShareAlike 4.0 International License (CC BY-SA 4.0).

The full legal text of the license is available at: https://creativecommons.org/licenses/by-sa/4.0/legalcode

A human-readable summary is available at: https://creativecommons.org/licenses/by-sa/4.0/

2. What This License Permits

Under CC BY-SA 4.0, anyone is free to:

  • Share — copy and redistribute the material in any medium or format
  • Adapt — remix, transform, and build upon the material for any purpose, including commercially

The licensor (author) cannot revoke these freedoms as long as the license terms below are followed.

3. License Conditions

Use of published articles is subject to the following conditions:

  • Attribution — Users must give appropriate credit to the original author(s), provide a link to the CC BY-SA 4.0 license, indicate the original publication source (AJCIL), and indicate if changes were made to the original work. This must be done in any reasonable manner, but not in a way that suggests the author or AJCIL endorses the user or their specific use of the work.
  • ShareAlike — If a user remixes, transforms, or builds upon a published article, they must distribute their resulting contributions under the same license (CC BY-SA 4.0), or a license that Creative Commons has approved as essentially equivalent ("BY-SA Compatible License").
  • No additional restrictions — Users may not apply legal terms or technological measures that legally restrict others from doing anything the license permits.

4. Retained Author Rights

Authors who publish with AJCIL retain copyright of their work and grant the journal (and the public) the right of first publication under the CC BY-SA 4.0 license. Authors are free to:

  • Enter into separate, additional contractual arrangements for the non-exclusive distribution of the journal's published version of the work (e.g., posting it to an institutional repository or publishing it in a book), with acknowledgment of its initial publication in AJCIL.
  • Post their work online (e.g., in institutional repositories or on personal websites) prior to and during the submission process, as doing so can lead to productive exchanges and earlier citation.

5. Recommended Attribution Format

When citing or reusing content from AJCIL, the following attribution format is recommended (adjust to the citation style in use):

[Author Name(s)], "[Article Title]," AKSEN Journal of Contemporary Islamic Law [volume], no. [issue] ([year]): [page range]. Licensed under CC BY-SA 4.0. https://creativecommons.org/licenses/by-sa/4.0/

[Placeholder: insert the DOI format once assigned, e.g., "https://doi.org/10.xxxxx/ajcil.vXiX.XXX," so attributions can link directly to the article of record.]

6. Suitability of CC BY-SA 4.0 for AJCIL — Note for the Editorial Board

Before finalizing this as AJCIL's standing policy, the editorial board may wish to consider two practical implications specific to CC BY-SA 4.0:

  • Commercial reuse is permitted. Unlike CC BY-NC-SA, this license does not restrict commercial use — third parties (including commercial publishers) may republish or adapt articles commercially, provided attribution and ShareAlike conditions are met. If the board intends to restrict commercial reuse, CC BY-NC-SA 4.0 would need to be adopted instead, and this document revised accordingly.
  • ShareAlike applies to derivatives, not the article itself. The ShareAlike condition binds anyone who creates and shares an adaptation of a published article; it does not require, for example, a citing author's own unrelated article to also be released under CC BY-SA.

7. Third-Party Content

Where a published article incorporates third-party material not owned by the author (e.g., a reproduced table, image, or a lengthy quotation requiring separate permission), that material is not automatically covered by the CC BY-SA 4.0 license unless explicitly stated. Authors are responsible for ensuring they have the necessary rights or permissions for any such third-party content included in their manuscript, and for clearly indicating its separate copyright status in the article (e.g., in a figure caption).

8. Disclaimer

Creative Commons is not a law firm and does not provide legal services or legal advice; the license is made available on an "as-is" basis. This notice is a summary for the convenience of authors and readers and is not a substitute for the full legal text of the license linked in Section 1.
